So you stumbled on this little forum, let's get this started.

Tate Publishing is a publishing company based in Mustang Oklahoma. Founded by Richard and Rita Tate in 2004, the growing Christian-based company took on many authors and employees over many years to become a recognizable name in the business. Unfortunately, their reputation of poor communication and timeliness has marred their ability to sustain a full office and retain contacts with their authors.

As of January 19th, 2017 - it appears the company has begun a "transition phase" for their authors. They've provided two pdf forms for authors for marketing or general release (which may include files). DO NOT SIGN THESE. 

I agree to indemnify and hold harmless Tate Publishing & Enterprises, LLC and its subsidiaries, officers, executives, employees, and any such heirs they may have. I understand that termination of these agreements does not entitle me to any refund or monetary compensation whatsoever.

The Marketing Release form also requires a 50$ processing fee to get your files. All authors who've published through Tate Publishing hold copyrights over their books - please check your contracts to validate this and what parts of your book may not be covered under the copyright.

If Tate Publishing failed to file copyright on your book, you may do so at Copyright.gov. There is a filing fee, but using a third party to assist in filing will incur additional cost to your copyright claim.

If Tate Publishing or any other organization or individual has infringed on your copyright, use the National Intellectual Property Rights (IPR) Coordination Center to claim Intellectual Property theft.


    This website was intended to bridge the lack of information for anyone who wishes to be a part of the conversation. Since Tate Publishing appears to be closing their doors, this website is intended to provide as much and as clear information as possible to authors and provide resources, contacts, and an open forum of communication.

The distribution of books was outsourced to Lightning Source, and Ingram Publisher. You can contact them to see what options are available. There were other distribution points for Hardcover books as well, but I don't have their information readily available.

  • File a complaint with Amazon for Infringement - this may not be the proper method of complaint with Amazon

Final Assets
Tate Publishing stored Author and Artist assets slightly differently throughout their process. These include, but are not limited to, Illustrations, Websites, Copy (text), Production Materials (PDF's, Print-ables), Video or Animated Media. This information is important to consider when filing a class action lawsuit or an intellectual property infringement. By collecting this information, I can make better decisions on what processes or suggestions to provide for both suits. In the slim event that all author/artist files are made available - this information will provide rapid assistance to which files are being requested.

Other Things
Any authors who fill out the form who are:

  • interested in pursuing additional publishing/production with another company
    • will be emailed with a list of publishing and production options
  • interested in self-publishing
    • will be emailed a list of self-publishing resources, contacts gathered through this process (like previous employees who are interested in working with their authors) 
  • interested in a Class Action Suit
    • will be contacted via Email or by Phone and be offered to be put in contact with any lawyers or organizations interested in pursuing a class action suit

 

I too have been offered this form, in attempt of terminating my contract. I tried to email back with questions and my email was sent back undeliverable! In fact my emails to all my contacts are coming back that way. No answer to phone calls, I only want to end my contract, but do not want to sign away my rights to collecting what is monetarily mine.

I'm a recently published Tate author who is/was presently waiting on a paid for order of books that were ordered 12 weeks ago. The mystery as to what's taken so long and the lack of contact I've had with staff over the last month has become much clearer over the last couple of days of browsing articles and websites like this (for which I'm thankful!). I'm still unsure about the best course of action at this point, but I think I'll start by calling the Oklahoma Atty. Gen. As for the form you offer for those who "are owed files or return on [their] investment/payments," I wonder what will be done with whatever information I may provide there, so a little more information on the purpose of that option might be helpful for others in my position (who are owed either product or repayment, and royalties).

That's a very good point. I've been too stretched between my day job, recent projects and keeping on top of the Tate Publishing implosion to have done a sanity check on these new additions (and forms). I've added the following to the form descriptions to help in transparency.

When Tate Publishing Company files for bankruptcy, will the copyrights be given to the author if the author is unsure of the copyrights?

I did not know this when I first started with them , my life story and mine spent my savings on it I can not go anyplace else do not have the funding to do so what can I do thank you ,

My name is Shawn, and I only found out about this through a recently fired employee of Tate. I have a Bogo contract with them and album 1 of the album deal was supposed to be finished by now so that I could do vocals in a separate studio. I have so many moving parts in motion right now it's hard to know where to start. Am I going to lose my contract?

I have two books produced through Tate Publishing and purchased a lifetime free publishing voucher as well. Is there any possibility of return on this investment given the amount of ligation out there? I have not signed the contract because it seems like they are holding our work hostage and demanding a fee for its safe return while hiding the loot gathered from literally hundreds of authors.

TATE in now OUT OF BUSINESS. IT HAS CLOSED ITS DOORS. My book was completed and ready to be published in November 2016, but my first copy for approval NEVER ARRIVED. I was told it was put in the mail and it would take 5-10 business days. That was on Nov. 25, 2016. It is now 02/05/2017 AND STILL NO BOOK IN PRINT.
I did hear from Tate saying they were reorganizing, and they will be up and running soon. This was in mid January. Let's call it what it was: AN OUTRIGHT LIE...
TATE broke my contract by not publishing my book and going out of business. Why would I sign anything. Authors have lost millions of hard earned dollars with nothing to show for it. TIME TO START A CLASS ACTION against Tate to retrieve those monies.
Finally, On August 25, 2016 I was asked for another $400 to put my book on tape. They said they had a professional actor who would read it and then put it up for sale... At this time they already KNEW THEY WERE ON THEIR WAY OUT, AND STILL ASKING AUTHORS FOR MONEY. This was SHAMEFUL. Not mentioning that they claimed to be A CHRISTIAN PUBLISHER.

I currently have 2 books that have been published through Tate Publishing and one slated for release on Feb. 14, 2017. Mycopies have been paid for but obviously never received and I don't have a clean copy of the finished manuscript. It was never sent. I feel lost and don't exactly know how to proceed in protecting the work that is mine, the royalties that I'm due and any future potential earnings. What do we do with the books out on Amazon? Where will they go and will we get any benefits from their sales? I haven't signed any forms through the Tate links and am looking to this forum for guidance and accurate information as this situation unfolds.

FYI - Since the Tates have absconded with large sums of cash from numerous authors, I recommend that you contact the I.R.S. and file a report. They will not be able to discuss the Tates' private files with you but they welcome referrals about potential tax fraud (unreported income) that could potentially help your lawsuits. Just thought you could use this info.
